Slip/Trip and Fall

Property owners have a duty to ensure that their premises are in a reasonably safe condition, which are free of dangerous, hazardous, and/or defective conditions.  If you have been harmed by such a condition on another’s sidewalk, personal residence, restaurant, grocery store, mall, hotel, office building, school, park, theater, museum, or other property, then you may be eligible to file a premises liability claim and receive compensation for your injury. 

 “Slip and Fall” and "trip and fall" injuries are commonly caused dangerous, hazardous, and/or defective conditions on a premises, and they commonly occur from uneven or slippery surfaces, although they can also be the result of:

  • broken sidewalks
  • raised sidewalk flags
  • pot holes
  • raised cracks in the roadway
  • broken or crumbling curbs 
  • crumbling stairs or stairs not built to code
  • improper lighting
  • wet floors
  • exposed electrical wiring
  • raised flooring
  • falling debris
  • obstructed pathways

Although premises liability law seeks to protect persons who are injured as the result of the property owner’s negligence, it is often very difficult to prove liability because it generally requires demonstrating that the owner had actual or constructive notice of the dangerous, hazardous, and/or defective condition on their premises or caused and/or created same. 

Sometimes, when the property owner is a municipality, it can be even more difficult to prove because it may require such things as prior written notice of the defect or special use of the location, not to mention other special requirements when suing a municipality, such as shortened time frames and Notices of Claim.
